Update for December 12, 2025: Life Insurance Lawsuits

According to reports, a funeral home chairman in Texas has been accused of defrauding a woman out of her sister’s life insurance coverage. Unfortunately, similar to life insurance broker fraud, this type of fraud is also all too common. If you are concerned that you may be a victim of any form of life insurance fraud, we strongly encourage you to schedule a free consultation with an attorney at Oberheiden Law Group.

Previous Life Insurance Fraud Updates

November 28, 2025This article from Nasdaq discusses some common warning signs for life insurance scams. If you are concerned that you may be a victim of a life insurance scam, it is worth a read.

With that said, these are not the only warning signs for life insurance scams, and many of these scams are becoming increasingly sophisticated. If you have concerns, it will be worth talking to an experienced life insurance attorney who can help you determine if legal action is warranted.

November 14, 2025 – Here is another article discussing Kyle Busch’s life insurance lawsuit against Pacific Life Insurance Company. The article highlights when Busch first started to have concerns, quoting the NASCAR driver as stating, “We got on a call with the guy who sold me the premium policies and he ran me around in all these circles, couldn’t answer the questions, so I was like, this is fishy.”

This, unfortunately, is an all-too-common scenario, and this type of evasiveness is frequently a red flag for fraud. If you have concerns about your (or a loved one’s) life insurance policy and would like to speak with an attorney, we encourage you to schedule a free consultation at Oberheiden Law Group today.

October 31, 2025 – According to reports, NASCAR driver Kyle Busch and his wife have filed a lawsuit against Pacific Life alleging that the company, “design[ed] and promot[ed] a series of complex indexed universal life (IUL) policies as ‘tax-free retirement plans’ that were misrepresented as safe, self-funding investment vehicles.” Fox News quotes the champion driver as stating:

“These policies were sold to us as part of a retirement plan—something safe and secure that would grow tax-free and protect our family long after racing. We trusted the people who sold them, and the name Pacific Life. But the reality is far different. What was pitched as retirement income turned out to be a financial trap.”

While these are only allegations at this stage, if you purchased an IUL policy from Pacific Life, it may be worth talking to a life insurance attorney about your legal rights. If you’d like to schedule a free consultation, contact us today.

October 24, 2025 – We have recently seen life insurance fraud cases involving brokers and agents located on both coasts. Unfortunately, this truly is a nationwide issue. If you believe that you or a loved one may be a victim of life insurance fraud anywhere in the United States, we strongly encourage you to schedule a free and confidential consultation with an attorney at Oberheiden Law Group.

October 17, 2025 – With the end of the year fast approaching, we are already seeing some “Best of 2025” lists start to emerge. This includes lists of the “Best Life Insurance Companies of 2025.”

Unfortunately, these lists are often little more than marketing exercises. As a result, if you are searching for life insurance or have questions about your life insurance company, it is important to take these kinds of lists with a grain of salt. Before buying life insurance, it is important to do your due diligence; and, if you have concerns after purchasing life insurance, you should promptly talk to a lawyer who can help you understand if you may be a victim of life insurance fraud.

October 10, 2025 – The NAIC resource we discussed last week highlights three common forms of life insurance fraud that present risks for purchasers, policyholders, and beneficiaries:

  • “Fake insurance companies or agents defraud consumers by taking money for premiums on bogus policies with no intention of paying claims;”
  • “There are also legitimate, companies that sell non-insurance products marketed to look like real insurance;” and,
  • “A dishonest insurance agent might collect premiums from a customer without reporting them to the company.”

Do any of these hit home? If you suspect that you may be a victim of life insurance fraud, we strongly recommend speaking with an attorney. It costs nothing to learn about your legal rights; and, if you are a victim of fraud, you can hire a lawyer to help you seek justice at no out-of-pocket cost to you.

October 3, 2025 – Here is a resource on life insurance fraud from the National Association of Insurance Commissioners (NAIC). While it’s old, originally published in 2017, it remains relevant today. If you have reason to believe that you (or a loved one) may be a victim of life insurance fraud, you should not ignore your concerns. Fraud in the insurance industry is a very real issue, and victims of insurance fraud can—and should—hire a lawyer to help them seek just compensation.

September 26, 2025 – As we discussed in last week’s update, many life insurance fraud lawsuits involve indexed universal life insurance policies, or “IULs.” There are two key reasons why:

First, IULs are complex insurance products. As a result, many people who buy them don’t understand them. Instead, they rely on their broker’s advice, and they assume that investing in an IUL will pay off in the long run.

Second, selling IULs is a profitable business. As a result, brokers have a strong financial incentive to sell IULs to their customers. While brokers should advise their customers with their customers’ best interests in mind, the unfortunate reality is that, far too often, they do not.

September 19, 2025 – Many cases of life insurance fraud involve indexed universal life insurance policies, or “IULs.” Victims have recovered millions of dollars after proving that they were misled by insurance companies’ and brokerages’ deceptive marketing practices. If you purchased an IUL and were not adequately informed of the risks involved, we may be able to help you recover your losses. Contact us today for a free and confidential consultation.

September 12, 2025 – Here’s a story about a former life insurance broker in Maryland who was sentenced to 12 years in prison for defrauding life insurance companies and individuals of more than $20 million. The broker’s wife was also sentenced to four years in prison. Sadly, these kinds of cases are far more common than they should be.
If you are (or believe that you may be) the victim of a life insurance fraud scheme, we can help you. To speak with an experienced lawyer about your situation in confidence, contact us for a free consultation today.

September 2, 2025 – Here is another article discussing the case we reported on last week. According to the article, the former Connecticut insurance agent, “is accused of running a multi-state life insurance scam that allegedly took money from at least nine people for policies that either didn’t exist or had already lapsed.” If you need more information about this case—or any other case involving life insurance fraud—we invite you to contact us for a free and confidential consultation with a life insurance attorney at Oberheiden Law Group.

August 29, 2025 – A former insurance company employee was recently charged with perpetrating a years-long life insurance fraud scheme in Connecticut. As reported by CT Insider, the defendant was fired from the insurance company for misappropriating client funds before allegedly stealing more than $250,000 from victims, including people close to him, between 2020 and 2024. Unfortunately, cases like this one are all too common. If you have concerns about life insurance fraud under any circumstances, you should not ignore them. To discuss your situation with an experienced life insurance fraud attorney in confidence, contact us today.

August 22, 2025 – Here is another recent example of a life insurance fraud case involving alleged broker misconduct. Earlier this year, the Pennsylvania Attorney General announced charges against a broker who is accused of, “fabricat[ing] hundreds of life insurance policies to earn more than $600,000 in commissions.” The broker is facing charges including identity theft, theft by deception, and insurance fraud.

Importantly, even when cases like these lead to criminal convictions, they generally do not lead to financial recoveries for victims. To recover their losses, victims must generally hire a lawyer to represent them in civil court. If you believe that you may be a victim of life insurance fraud, our lawyers can help, and we invite you to contact us for a free, no-obligation consultation.

August 15, 2025 – Along with fraud claims against life insurance companies, we also handle fraud claims against life insurance agents and brokers. Law enforcement authorities often handle similar types of cases as well. For example, the California Department of Insurance (DOI) recently published a press release discussing charges against a former insurance agent who is accused of perpetrating, “a large-scale insurance fraud scheme involving misrepresented life insurance policies that resulted in fraudulent commissions totaling over $1.4 million.”

Were you misled by a life insurance agent or broker who earned a hefty commission at your expense? If so, you may have grounds to take legal action. Contact our attorneys for more information.

August 8, 2025 – As a beneficiary, it can be difficult to know when a life insurance company’s actions cross the line from good-faith claim handling practices to fraud. We understand this, and we do not expect you to have a clear understanding of your legal rights when you get in touch. Our lawyers can evaluate the insurance company’s conduct, and we determine if legal action is warranted. If it is, we can then take all necessary and appropriate legal action on your behalf. Contact us to arrange a free and confidential consultation today.

August 1, 2025 – Along with charging excessive premiums, what are other common allegations in life insurance fraud lawsuits? Wrongful denials and other bad-faith claims handling practices are extremely common allegations as well. If you are struggling to obtain life insurance coverage (or have been denied coverage) under a loved one’s life insurance policy, our lawyers can determine if you have grounds to take legal action.

July 25, 2025 – As we discussed last week, charging excessive premiums is a common allegation in insurance fraud lawsuits. But, it is just one common allegation of many. Unfortunately, far too many grieving family members find themselves in disputes with the insurance companies when all they want to do is try to move on with their lives.

At Oberheiden Law Group, we are passionate about fighting for victims of bad-faith insurance practices. If you are struggling to collect the life insurance payment your family deserves, we want to help you. To learn how we can help, contact us for a free consultation today.

July 18, 2025 – Kansas City Life Insurance Company has reportedly agreed to pay $45 million to settle multiple lawsuits related to cost of the company’s universal life and variable universal life insurance policies. While the report does not discuss the details of the litigation—and while Kansas City Life Insurance Company continues to deny wrongdoing—charging excessive premiums is a common allegation in insurance fraud lawsuits against life insurance companies.

July 11, 2025 – What is “life insurance fraud”? Simply put, life insurance fraud occurs any time a life insurance company improperly denies coverage to a beneficiary or beneficiaries. If you believe that an insurance company is refusing to provide the coverage to which you are legally entitled, you can—and should—talk to a lawyer about your legal rights. Contact us for a free, no-obligation consultation today.

July 4, 2025 – Yesterday, CBS News published an article discussing some key questions about life insurance for senior citizens in today’s economy. While the article provides some useful tips, one concern it doesn’t mention is the concern of life insurance fraud. Improper claim denials are common, and these denials can leave family members facing a long and difficult road ahead.

When purchasing life insurance, it is a good idea to research the carrier—especially if it isn’t well known. If the carrier has a history of complaints, this could be a sign that you want to choose a different company.

why life insurance claims get denied

Why Was I Denied My Life Insurance Benefits?

It’s an unfortunate reality that life insurance companies frequently deny claims, even after collecting billions in premiums annually. You might think that once a policyholder passes away, getting the benefits is straightforward. However, denying and disputing claims is a common occurrence.

There are many reasons an insurer might deny a claim. These can range from alleged unpaid premiums to more complex claim disputes and policy issues. One of the most frequent reasons we see for denial is “material misrepresentation.” This essentially means the insurance company believes the policyholder’s initial application either failed to disclose information or provided inaccurate details that would have impacted their eligibility for the policy.

If your life insurance claim has been denied, don’t lose hope. Oberheiden Law Group can help you fight for the benefits you deserve.

Can I Dispute My Denied Life Insurance Benefits?

Being denied life insurance benefits can be a profoundly distressing experience, especially when you’re already grieving the loss of a loved one. The good news is that a denial is often not the final word. You absolutely can dispute a denied life insurance claim, and many such denials are successfully overturned with the right approach.

Insurance companies are required to provide a specific reason for their denial, and you have the opportunity to challenge that decision. The process can be complex, often involving detailed policy review, evidence gathering, and strategic communication with the insurer. This is why many beneficiaries choose to seek legal assistance to navigate the appeals process effectively.

How To Dispute Denied Life Insurance Benefits

While you have a right to dispute any denied life insurance benefits, you must comply with relevant laws, contractual terms, and deadlines. There is a specific process you should follow to submit disputes of denied life insurance benefits.

  1. Understand the Reason for Denial: The first step is to thoroughly review the denial letter from the insurance company. This letter should clearly state the specific reasons your claim was denied, often referencing policy clauses. Understanding their exact reasoning is important for building your counter-argument.
  2. Gather All Relevant Documents: Collect every document related to the policy and the claim. This includes the original life insurance policy, the application filled out by the policyholder, the death certificate, all medical records, proof of premium payments, and any correspondence you’ve had with the insurance company. A detailed timeline of events can also be helpful.
  3. Review the Policy and Application: Compare the insurance company’s stated reasons for denial against the actual language of the policy and the information provided in the original application. Look for inconsistencies, ambiguities, or errors in their interpretation. For instance, if they cite a “material misrepresentation,” review the application to see if the alleged misrepresentation was truly significant to the policy’s issuance.
  4. Draft a Formal Appeal Letter: Most insurance companies have an internal appeals process. You’ll need to submit a comprehensive appeal letter that directly addresses each reason for denial cited by the insurer. Be clear, concise, and factual. Attach all supporting documentation that contradicts their denial or provides additional context. Ensure you meet any deadlines specified in the denial letter for submitting an appeal.
  5. Contact a Life Insurance Lawyer: This is a critical step. Life insurance law is complex, and insurance companies have experienced legal teams whose job is to protect the company’s bottom line. An experienced life insurance attorney can:
  • Interpret complex policy language and legal statutes.
  • Identify errors or bad faith practices by the insurer.
  • Help gather compelling evidence, including witness testimony if necessary.
  • Draft a strong and persuasive appeal letter.
  • Negotiate with the insurance company on your behalf.
  • Represent you in litigation if the appeal is unsuccessful.
  1. External Review and Litigation (If Necessary): If your internal appeal is denied, you may have the option for an external review by an independent third party. If all administrative appeals fail, your life insurance dispute attorney can advise you on whether to pursue litigation against the insurance company to recover the benefits.

Remember, time limits often apply to disputing denied claims, so it’s important to act promptly. Consulting with legal professionals early in the process can significantly improve your chances of a successful outcome.

Common Reasons Life Insurance Claims Are Denied

Life insurance companies are businesses–their primary goal is to manage risk and pay out claims according to their policy terms. Unfortunately, this often means that a life insurer may deny even valid claims, and group life insurance policies are no exception. Understanding the common reasons for denials is the first step in effectively disputing them.

Misrepresentation on the Application

One of the most frequent reasons for denial is “material misrepresentation” on the original application. This occurs when the policyholder allegedly failed to disclose, or inaccurately disclosed information relevant to their eligibility or risk. This could involve health history (e.g., pre-existing conditions, smoking habits), high-risk hobbies, or even financial details. Even innocent mistakes can be scrutinized, particularly if the death occurs early in the policy’s life.

Lapsed Policy Due to Non-Payment

A policy can lapse if premiums are not paid within the grace period allowed by the insurer. If the policyholder dies after the policy has lapsed, the coverage typically terminates, and the beneficiaries will not receive the death benefit. However, there are often nuances, such as automatic premium loans from cash value or grace periods that might still apply.

Exclusions Specified in the Policy

Life insurance policies contain specific exclusions – commonly including cases of accidental death or other causes of death for which the policy will not pay out. Common exclusions include death due to illegal activities, acts of war, or engaging in certain high-risk hobbies not disclosed or covered. Suicide is also typically excluded for a certain period of time.

Disputes Over Beneficiary Designations

Sometimes, a claim is denied not because of the policyholder, but due to a dispute over who the rightful beneficiary is. This can happen if beneficiary designations are unclear, outdated (e.g., after a divorce without updating the policy), or if there are allegations of undue influence or fraud in changing the beneficiary.

Contestability Period Issues

Most life insurance policies have a “contestability period,” typically the first two years after the policy is issued. During this time, the insurance company has the right to thoroughly investigate the application for any misrepresentations or fraud. If the policyholder dies within this period, the insurer is far more likely to conduct a deep dive into the application and deny the claim if any discrepancies are found.

life insurance and bad faith

What Does It Mean When an Insurance Company Acts in “Bad Faith?”

When an insurance company acts in “bad faith,” it means they have failed to uphold their legal obligation to treat policyholders fairly and honestly. This duty, known as the “implied covenant of good faith and fair dealing,” is inherent in every insurance contract.

Bad faith is more than just a mistake or a disagreement over a claim. It involves a deliberate attempt by the insurer to avoid paying legitimate benefits or to unduly delay the process for their own financial gain. Examples include:

  • Unreasonable denial of a valid claim without proper investigation or justification.
  • Undue delays in processing or paying a claim, often by requesting excessive or irrelevant documentation.
  • Misrepresenting policy terms or the law to trick beneficiaries into accepting less than they’re owed.
  • Offering unreasonably low settlement amounts for valid claims.

If you suspect bad faith, legal action may be warranted beyond simply appealing the claim denial.

Oberheiden Law Group Helps with Ex-Spouse Life Insurance Claim Matters

Life insurance claims involving ex-spouses often present complex legal challenges. A common issue arises when a divorce occurs, but the life insurance policy’s beneficiary designation is never updated.

While many assume a divorce decree automatically revokes an ex-spouse as a beneficiary, this isn’t always the case, and state laws vary significantly on “revocation upon divorce” statutes.

Further complications emerge if the divorce decree required one party to maintain life insurance for the other (e.g., for alimony or child support) but this obligation was not fulfilled, or the beneficiary was later changed.

Discrepancies between the policy, the divorce decree, and state/federal law can lead to heated disputes among competing claimants, such as a new spouse or children. Resolving these requires careful legal analysis to determine who is rightfully entitled to the benefits.
