What Constitutes Sexual Assault or Abuse in Texas?

Texas law defines sexual assault as intentionally or knowingly engaging in sexual contact with another person without their consent. “Sexual contact” includes any touching of the anus, genitals, or breasts of another person, or any touching of another person with the intent to arouse or gratify the sexual desire of either party.

Sexual abuse can also include other forms of non-consensual sexual acts, such as exploitation, indecent exposure, or online solicitation of a minor. The definition also encompasses situations where consent is invalid due to factors like force, threat, or the victim’s incapacity to consent (e.g., due to age, intoxication, or mental impairment)

Can I Sue the Abuser If They Were Not Criminally Charged or Acquitted?

Yes. A criminal case requires proof “beyond a reasonable doubt,” a very high standard. A civil case, on the other hand, requires proof by a “preponderance of the evidence,” meaning it is more likely than not that the assault or abuse occurred. Therefore, it is possible to win a civil case even if a criminal case was not pursued or was unsuccessful.

What Damages Can I Recover in a Civil Lawsuit?

In a Texas civil lawsuit for sexual assault or abuse, you may be able to recover various types of damages, including:
