The intent of the Act was to create a national trademark registration system and to <a href=\"https:\/\/federal-lawyer.com\/asset-protection\" data-type=\"link\" data-id=\"https:\/\/federal-lawyer.com\/asset-protection\">provide protection<\/a> to those who secured a trademark. Interestingly, the Lanham Act also provided reasonably priced childcare for families during World War II, which has since served as a model to lawmakers in developing more current policies. However, the main thrust of the Lanham Act deals with trademark creation and enforcement.<\/p>\n\n\n\n<p>A trademark is a recognizable sign, design, or expression that identifies the source of a product or service. Simply put, the Lanham Act covers what parties must do to obtain a trademark and provides remedies in the event another party infringes upon the trademark holder&#8217;s rights. Since the passage of the Lanham Act, courts have continued to uphold the rights of trademark holders, including in a 2017 <a href=\"https:\/\/www.oyez.org\/cases\/2016\/15-1293\" target=\"_blank\" rel=\"noopener noreferrer\">opinion<\/a> holding that a portion of Section 2(a) of the Lanham Act prohibiting the federal registration of potentially disparaging trademarks and service marks violated the Free Speech Clause of the First Amendment.<\/p>\n\n\n\n<p>Putting aside the requirements to obtain a trademark, the Lanham Act provides detailed procedural mechanisms by which parties who believe another infringed upon their rights can pursue relief from the courts. There are a few ways in which lawsuits under the Lanham Act can come up:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Trademark Infringement<\/h3>\n\n\n\n<p>Trademark infringement is the unauthorized use of another\u2019s trademark. When asked to resolve a trademark infringement case, courts consider whether the party alleged to have committed trademark infringement likely caused confusion about the product\u2019s origin. This \u201clikelihood of confusion\u201d standard requires courts to consider the following:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The strength of the mark;<\/li>\n\n\n\n<li>The proximity of the goods;<\/li>\n\n\n\n<li>The similarity of the marks;<\/li>\n\n\n\n<li>Evidence of actual confusion;<\/li>\n\n\n\n<li>The similarity of marketing channels used;<\/li>\n\n\n\n<li>The degree of caution exercised by the typical purchaser; and<\/li>\n\n\n\n<li>The defendant&#8217;s intent.<\/li>\n<\/ul>\n\n\n\n<p>Thus, whether trademark infringement exists is a heavily fact-based inquiry. The use of a trademark on an entirely unrelated good will not give rise to a violation of the Lanham Act. For example, the term \u201cMac\u201d is used by both Apple and Estee Lauder. This is not trademark infringement because a consumer would not likely believe that Apple also makes MAC cosmetics. However, the use of trademarks in products that share certain similarities can give rise to an infringement suit.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">False Advertising and Unfair Competition<\/h3>\n\n\n\n<p>The Lanham Act also allows businesses to bring a case against another business for false or misleading advertising. More specifically, <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/15\/1125\" target=\"_blank\" rel=\"noopener noreferrer\">Section 43(a)<\/a> of the Lanham Act prohibits someone from using any<\/p>\n\n\n\n<div style=\"padding-left:2em;margin-bottom:1.5em;font-style:italic;\">\n<p>word, term, name, symbol, or device, or any combination thereof, or any false designation of origin, false or misleading description of fact, or false or misleading representation of fact, which,<\/p>\n\n<p>(A) is likely to cause confusion or mistake, or to deceive as to the affiliation, connection, or association of such person with another person, or as to the origin, sponsorship, or approval of his or her goods, services, or commercial activities by another person, or<\/p>\n\n<p>(B) in commercial advertising or promotion, misrepresents the nature, characteristics, qualities, or geographic origin of his or her or another person\u2019s goods, services, or commercial activities, shall be liable in a civil action by any person who believes that he or she is or is likely to be damaged by such act.<\/p>\n<\/div>\n\n\n\n<p>While this is hardly a model of clarity, Section 43(a) prohibits one business from making any statement that could lead to confusion about their product or another\u2019s product. It also precludes a business from making statements that may lead a consumer to believe the business\u2019s products are endorsed or associated with another company.<\/p>\n\n\n\n<p>However, to prove a false or misleading advertising claim under the Lanham Act, a party must establish each of the following elements:<\/p>\n\n\n\n<ol style=\"list-style-type:1\" class=\"wp-block-list\">\n<li>The other party made a false or misleading statement of fact.<\/li>\n\n\n\n<li>The statement was used in a commercial advertisement or promotion.<\/li>\n\n\n\n<li>The statement was deceptive or was likely to deceive materially.<\/li>\n\n\n\n<li>The statement was made in interstate commerce, and<\/li>\n\n\n\n<li>The statement caused or is likely to cause competitive or commercial injury to the other party.<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">Trademark Dilution<\/h3>\n\n\n\n<p>Trademark dilution is the term used to describe the unauthorized use of a trademark that is likely to weaken the distinctive quality of the mark or otherwise harm the interests of the owner. Unlike an infringement action, trademark dilution can occur when a company uses a well-known trademark in marketing an unrelated good. The elements of a trademark dilution claim require the plaintiff to prove the following:<\/p>\n\n\n\n<ol style=\"list-style-type:1\" class=\"wp-block-list\">\n<li>The plaintiff&#8217;s mark is famous;<\/li>\n\n\n\n<li>Another party used the plaintiff&#8217;s mark after it became famous;<\/li>\n\n\n\n<li>The other party\u2019s use of the mark was for commercial purposes; and<\/li>\n\n\n\n<li>The other party\u2019s use of the plaintiff&#8217;s mark likely caused dilution.<\/li>\n<\/ol>\n\n\n\n<p>Often, significant litigation surrounds whether a mark is famous.
